In the course of the increasing commercialization of art, typical style elements of famous artists are often used on consumer goods or for advertising. Can any formative style elements closely linked to the work and personality of an artist be imitated, marketed and commercialized by everyone? This work provides an overview of legal protection options for formative style elements and deals with controversial issues of intellectual property law in this context. In particular, the delimitation of property rights is examined in detail, which is of great relevance with regard to the often generously dimensioned protection and the associated valuation conflicts. In addition, the topic dealt with in this volume is particularly topical in view of the growing fusion of art, consumption and mass culture.
