La ricerca e suddivisa in due parti: nella prima si discute della condizione giuridica in cui versa il cittadino romano riscattato dal nemico (civis redemptus ab hostibus), il quale, in base alle opinioni dei giuristi classici e ai rescritti imperiali, risulta assoggettato al potere del riscattante (qualificato in termini di diritto di pegno) fino alla restituzione del prezzo pagato per il riscatto; nella seconda si discute della condizione giuridica in cui versa lo schiavo riscattato dal nemico (servus redemptus ab hostibus), la cui proprieta spetta al riscattante, invece che all'antico padrone, secondo una costituzione imperiale di incerta datazione (la cd. constitutio de redemptis).
